Welcome to Martyx Industries. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

Use of the service

  • You must be at least 18 years old or have parental consent to use our services.
  • You agree not to misuse the services or violate applicable laws.
  • We reserve the right to modify or discontinue features at any time.

Purchases and payments

All purchases are subject to our pricing and availability. Payments are processed by third-party providers under their terms and security standards.

Intellectual property

All content, designs, and materials provided are owned by or licensed to Martyx Industries and are protected by applicable intellectual property laws. You may not reproduce or distribute content without permission.

Limitation of liability

To the fullest extent permitted by law, Martyx Industries will not be liable for any indirect, incidental, or consequential damages arising from the use of our services.

Privacy

Your use of our services is also governed by our Privacy Policy and our Cookie Policy.

Digital Content and Right of Withdrawal

All products sold through Martyx Industries are digital products (STL files for 3D printing). In accordance with EU Consumer Rights Directive 2011/83/EU, Article 16(m), the consumer cannot withdraw from the contract for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and their acknowledgment that they thereby lose their right of withdrawal. Before completing your order, you will be asked to provide this consent.

Applicable Law

These Terms of Service and all legal relationships between the seller and the buyer are governed by the laws of the Slovak Republic, in particular Act No. 40/1964 Coll. (Civil Code), Act No. 250/2007 Coll. on Consumer Protection, Act No. 102/2014 Coll. on Consumer Protection in Distance Selling, and Act No. 22/2004 Coll. on Electronic Commerce.

Alternative Dispute Resolution

The consumer has the right to contact the seller with a request for remedy if they are not satisfied with the way the seller handled their complaint or if they believe the seller has violated their rights. If the seller responds negatively to this request or does not respond within 30 days, the consumer has the right to submit a proposal for the initiation of alternative dispute resolution to an alternative dispute resolution body. The alternative dispute resolution body is the Slovak Trade Inspection (SOI), Bajkalská 21/A, 827 99 Bratislava, www.soi.sk. The consumer may also use the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

Consumer Protection

Consumer rights are protected by Act No. 128/2002 Coll. on State Control of the Internal Market in Matters of Consumer Protection and Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods or Provision of Services under Distance Contracts. Supervision of the seller's obligations is carried out by the Slovak Trade Inspection (SOI).

Complaints Procedure for Digital Products

In case of defects in digital content, the consumer has the right to file a complaint. Complaints can be submitted by email to the contact address listed on our About page. The seller is obliged to handle the complaint within 30 days from the date of the complaint. A defect in digital content includes, in particular: a damaged or incomplete file, a file that does not match the product description, or inability to download due to reasons on the seller's side. The seller is not responsible for defects caused by the buyer's hardware or software, incorrect use of files, or print settings.

Changes to these terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the new Terms.
